Punitive damages have a twofold purpose. They're designed to punish a party whose conduct is especially egregious and to deter others from engaging in the same kind of wrongdoing. In patent versus mid-continent systems, the Seventh Circuit considered whether punitive damages were appropriate in a case involving a deliberate breach of contract. James Patton owned a truck stop in Burns Harbor, Indiana, and R. L. Hildebrand owned a truck stop in nearby New Buffalo, Michigan. In 1971, the two men signed a franchise agreement with Mid-Continent Systems, a credit card company. The agreement established a loosely defined territory within which only truck stops owned by Patton and Hildebrand would be capable of accepting Mid-Continent's credit cards. In 1974, Mid-Continent awarded a franchise to Truckomat, a competing truck stop within the men's territory. Over the next several years, Patton and Hildebrand repeatedly notified Mid-Continent that it was in breach of the franchise agreement, to no avail. Patton and Hildebrand sued Mid-Continent in Federal District Court alleging breach of contract. A jury found that Mid-Continent had breached the party's agreement and awarded both compensatory and punitive damages. Mid-Continent appealed to the Seventh Circuit.
